1. Parties
a) This Stella Pulvis membership Agreement The owner of the website www.stellapulvis.com, Fevzipaşa mah. 48013 sok. no:9 Seyhan/ADANA, Karamut Tekstil Konf. San. ve Tic. Ltd. Şti. (hereinafter referred to as Stella Pulvis) and the internet user who is a member of the website www.stellapulvis.com on .
2. Subject of the Agreement The subject of this Agreement is the determination of the terms and conditions of use of the Member from the website www.stellapulvis.com owned by Stella Pulvis.
3. Rights and Obligations of the Parties
3.1. MEMBER accepts and undertakes to comply with all provisions of the legal legislation and not to violate such provisions while using the website www.stellapulvis.com. Otherwise, the MEMBER shall be fully and exclusively responsible for all legal and criminal liabilities that may arise.
3.2. MEMBER may not engage in activities (spam, virus, trojan horse, etc.) and transactions that prevent or make it difficult for others to use the services on the website www.stellapulvis.com.
3.3. MEMBER may not use the www.stellapulvis.com website in any way that disrupts public order, violates public morality, disturbs and harasses others, violates the intellectual and copyright rights of others and for any purpose contrary to the law.
3.4. The ideas and opinions expressed, written and expressions used by MEMBERS on the website www.stellapulvis.com are exclusively the MEMBERS' own personal ideas and comments and the MEMBER is solely responsible for the consequences of these ideas and comments. These opinions and thoughts have no relation and connection with Stella Pulvis. Stella Pulvis shall not be liable for any damages that may be incurred by individuals or organizations due to the ideas and opinions expressed by the MEMBER or any damages that may be incurred by the MEMBER due to the ideas and opinions expressed by individuals or organizations.
3.5. The MEMBER declares and undertakes that the personal and other information provided to the website www.stellapulvis.com while becoming a MEMBER is in accordance with the truth and that Stella Pulvis will compensate all damages that Stella Pulvis may incur due to the untruthfulness of this information in full and in cash.
3.6. The right to use the password received by the member from the Stella Pulvis website belongs exclusively to the member. üYE cannot give this password to any person. All legal and criminal liability regarding the use of the password belongs to the member.
3.7. Stella Pulvis shall not be held liable for any unauthorized interception of üYE data and any damage to üYE software and data. üYE agrees in advance not to claim compensation from Stella Pulvis for any damages it may incur due to the use of the website www.stellapulvis.com.
3.8. The Member agrees not to access or use the information and software of other internet users without authorization. Otherwise, the legal and criminal liability arising for this reason belongs entirely to the MEMBER.
3.9. MEMBER, who violates one or more of the articles listed in this Agreement, accepts and undertakes that he / she will be liable for all damages that may arise for this reason and will keep Stella Pulvis free from all damages, lawsuits, claims and claims that may arise for this reason and indemnify them against them.
3.10. Stella Pulvis has the right to unilaterally suspend or terminate the membership of the member and delete all data, documents and files of the member at any time without any liability.
3.11. All intellectual property rights regarding the design and software of the www.stellapulvis.com website and the text and visual content of the products are the property of Stella Pulvis and cannot be used by the MEMBER without the written permission of Stella Pulvis.
3.12. Stella Pulvis may collect certain information such as the name and Internet Protocol (IP) address of the Internet service provider used to access the site for the improvement and development of the www.stellapulvis.com website and/or within the framework of legal legislation, the date and time of access to the Site, the pages accessed while on the site and the Internet address of the Web site that provides direct connection to the site.
3.13.Stella Pulvis has the right to reach the user with communication, marketing, advertising, promotion, notification and other purposes through letters, e-mails, SMS, phone calls and other means, marketing, advertising, promotion, notification and other means through the address, e-mail address, fixed and mobile phone lines and other contact information written by the member in the registration form on the site or mobile application or updated by the member later. By accepting this agreement, the member accepts and declares that Stella Pulvis may engage in the above-mentioned communication activities for him, unless otherwise notified in writing.
3.14. Within the scope of the practices that are obliged and / or to be put into effect, the MEMBER will be informed and advertised about the promotions and service promotions of Stella Pulvis and Karamut Tekstil Konf. San. ve Tic. Ltd. Şti. declares and accepts that it allows information and advertisements to be sent to it about product and service promotions, advertisements, campaigns, advantages, surveys and other customer satisfaction practices of its brands. MEMBER declares and accepts that it allows Stella Pulvis to collect, use and archive the personal and shopping information and shopping and / or consumer behavior information that it has given to Stella Pulvis while becoming a MEMBER and / or in other ways in the past and / or in the future. Unless the MEMBER declares otherwise, the MEMBER declares and accepts that he / she allows the data to be collected, used and archived by Stella Pulvis when his / her membership ends. MEMBER accepts and declares that he / she will not make a claim for any direct and / or indirect material and / or indirect material and / or moral negative and / or moral and / or negative and / or positive, in short, any damage due to the collection, sharing, use, archiving and access to the above-mentioned information and will not hold Stella Pulvis responsible. If the MEMBER wishes to change his/her data sharing preferences, he/she may submit this request to Stella Pulvis' customer service call centers.
3.15. Stella Pulvis may disclose a member's personal information (a) if required to do so by applicable law or regulation or by a court order or administrative order, (b) in the circumstances set out in clause 3.13, and (c) where the member has consented to such disclosure.
3.16. Measures have been taken to ensure that the Stella Pulvis website is free of viruses and similar malware to the best of our ability. In addition, in order to ensure ultimate security, the user must supply his own virus protection system and provide the necessary protection. In this context, the MEMBER, by entering the Stella Pulvis website, is deemed to have accepted that he / she is responsible for all errors that may occur in his / her software and operating systems and their direct or indirect consequences.
3.17. Stella Pulvis has the right to change the content, design and software of the website at any time, to change, stop or terminate any service provided to users and to delete user information and data registered on the website at any time.
3.18. Stella Pulvis may update, amend or repeal the terms and conditions of this Agreement at any time and in any manner whatsoever without any notice and/or warning. Each updated, amended or repealed provision shall be effective for all MEMBERS on the date of publication.
3.19. Pursuant to this Agreement, Stella Pulvis is authorized to send information e-mails to the e-mail addresses of its members registered with it and information SMS to their mobile phones. By approving this Agreement, the MEMBER shall be deemed to have consented to the sending of information e-mails to the electronic mail address and information SMS to the mobile phone. In case the MEMBER wishes to opt out of receiving electronic mail and / or SMS, he / she will be able to cancel the sending of electronic mail and / or SMS by submitting this request to Stella Pulvis Customer Service. 3.13. article provisions are reserved.
4. Termination of the Agreement Either party may terminate this Agreement at any time by unilateral notice to the other party.
5. Status of Disputes
This agreement shall remain in force until the MEMBER cancels its MEMBERSHIP or until the MEMBERSHIP is canceled by Stella Pulvis. Stella Pulvis may unilaterally terminate the agreement by canceling the MEMBER's MEMBERSHIP in case of violation of any provision of the MEMBER's membership agreement.
6. Status of Disputes
Adana Central Courts and Enforcement Offices are authorized for all disputes arising out of or in connection with this Agreement
7. Enforcement
MEMBER's MEMBERSHIP registration is realized when the MEMBER reads and accepts all the articles contained in this Agreement. This Agreement has been concluded and entered into force at the moment the member becomes a MEMBER.
